Warranty
All goods sold hereunder are warranted to be free from defects in material and workmanship at the time of delivery to the original buyer. Upon prompt written notice by buyer of any claimed nonconformity or defect, which notice must be given within thirty (30) days from the date such nonconformity or defect is first discovered, and within one (1) year after the date of purchase, as provable by Buyer's written receipt, Seller's obligation under this warranty is limited, at its option, to repairing or replacing at its facility, with transportation charges prepaid by buyer, the goods or component part thereof that is proved to be other than as herein warranted. This warranty does not cover normal wear and tear and does not extend to any of Seller's goods which have been subject to misuse, accident, or improper care and maintenance or application, nor does it extend to goods which have been repaired or altered outside of Seller's facility unless authorized in writing by Seller or unless such repair or alteration is performed by Seller. Seller is not liable for damage to transported property or any injury to persons.

This warranty is in lieu of and excludes all other express or implied warranties of merchantability, fitness for a particular purpose or otherwise, arising by operation of law or otherwise. In no event will Seller be liable for incidental or consequential damages.

In any event, Seller's maximum liability hereunder, whether resulting from breach of contract or negligence or otherwise, shall not exceed the purchase price of the goods furnished by Seller. No legal proceeding shall be brought for any breach of this contract more than one (1) year after the accrual of the cause of action therefore.
